RESUMO: A presente investigação questiona a essência teo-lógica dos futuros contingentes. Para o efeito, analisa-se, primeiramente, a argumentação segundo a qual, sob certas condições lógicas, teológicas, ontológicas e cosmológicas antinecessitantes, detetadas por G. W. Leibniz, a abertura contingente do futuro parece ser compatível com o regime das "verdades contingentes pré-determinadas", regime enquadrado teologicamente pelo princípio do "futuro melhor" ou do "único futuro verdadeiro". No entanto, os futuros contingentes incitam, com e contra Aristóteles, ao desenvolvimento de uma lógica temporal e plurivalente, (...) ao modo de J. Łukasiewicz ou A. Prior. Essa lógica garante a abertura do futuro sem o oneroso custo metafísico da adesão a uma teo-lógica omnideterminante. A crítica do determinismo lógico, daí resultante, afigura-se mais coadunável com as condições pós-metafísicas inerentes à episteme agnósticacontemporânea, mas, nesse caso, a abertura do futuro implicaria uma profunda redefinição das próprias ideias e funções de "Deus", "matéria", "história" e "verdade". ABSTRACT: This paper investigates the theological essence of contingent futures. First, it analyses the argument according to which, under certain logical, theological, ontological, and cosmological conditions detected by Leibniz, the contingent openness of the future may be compatible with the regime of "pre- determined contingent truths", theologically grounded in the principle of an "optimal future" or a "single true future". However, the examination of contingent futures has also fostered, both for and against Aristotle's position, the development of a many-valued and temporal logic as proposed by J. Łukasiewicz or A. Prior. This logic safeguards the openness of future without the metaphysically expensive cost of adhering to an all-determining theo-logic. It hence follows that the critique of logical determinism seems to be more appropriate to express the post-metaphysical conditions of our present agnostic mentality. In this case, however, the openness of the future would entail a profound redefinition of the very ideas and functions of "God", "matter", "history", and "truth". (shrink)

Drawing on the interactionist perspective of innovation and on the sustainable ethical strength framework, the present research examines the moderating role of supervisors’ moral courage to go beyond compliance in the relationships between teamwork quality, team creativity, and team idea implementation. Two field studies, using multi-source and multi-wave data, indicated that teamwork quality was positively related to team idea implementation via team creativity, particularly when team supervisors revealed moral courage to go beyond compliance. When supervisors lacked such courage, teams struggled (...) to develop creative ideas and to implement them. Robustness checks and tests of alternative theoretical explanations indicated that our model and findings are robust. From a theoretical perspective, our findings indicate that, due to its empowering and promotion focused orientation, supervisors’ courage to go beyond compliance has relevance for the teamwork and team innovation domains, playing an important moderating role in defining whether quality teamwork leads to enhanced team creativity and team idea implementation. The current challenging organizational context demands that organizations adapt quickly and continuously in order to survive and maintain their competitive advantage. Considering this need, one of the responses given by companies has been the valorization of work teams and their capacity for innovation, as well as fostering positive skills and emergent states in employees, such as emotional carrying capacity and affective commitment, respectively. The aim of this research is thus to study the relationship between emotional carrying capacity and group innovation, (...) considering affective commitment as the mediating variable. To test these relationships, an empirical cross-sectional study was conducted including 138 Portuguese work teams belonging to different sectors of activity, composed of 625 members and their respective leaders. The results were analyzed through structural equation modeling and showed positive relationships between emotional carrying capacity and affective commitment, as well as between affective commitment and group innovation. In addition, the mediating role of affective commitment in the relationship between emotional carrying capacity and group innovation was also supported. Therefore, the results suggest that a work context in which members openly express their emotions contributes to reinforcing their affective attachment to the group, making them feel more involved and available to test and implement new ideas and procedures. The findings reinforce the benefits of promoting the expression of emotions and the development of healthy bonds between team members. (shrink)

Esta pesquisa tem como objetivo principal mostrar como a ética das virtudes aristotélica pode ser universalizada a partir da ideia de inteligibilidade ética de MacIntyre. Os capítulos deste trabalho visam explicitar, a partir dos escritos de Aristóteles na Ética a Nicômacos, o exercício das virtudes morais como indispensáveis para a realização agir bem e; demonstrar como as condições de inteligibilidade ética de MacIntyre, além de se transformar no elo de ligação conceitual entre a ideia de agir e a ideia de (...) narrativa, contribuem para pensarmos na teoria aristotélica como uma teoria do agir bem que pode ser cósmica e universal. Explaining is one of the most important everyday practices in science education. In this article, we examine how scientific explanations could serve as cultural tools for members of a group of pre-service physics teachers. Specifically, we aim at their use of explanations about forces of inertia in non-inertial frames of reference. A basic assumption of our study is that explanatory tools shape the ways we think and speak about the world. Drawing on the theory of mediated action, analysis illustrates three (...) major claims on scientific explanations: explaining is an act of actively responding to explanations presented by others ; the actual experience of explaining involves the enactment of power and authority; resistance might be a constitutive part of learning how to explain. These assertions expand the possibilities of dialogue between studies of scientific explanations and the social sciences. O livro reúne textos apresentados no II Workshop de Filosofia e Ensino, realizado na UFRGS em 2015, com a temática "Epistemologia e Currículo" -/- .

Analisar as relações sociais e econômicas efetuadas numa dada sociedade é de vital importância para sua compreensão. Neste artigo o objetivo estará voltado para compreender as estratégias de sobrevivência utilizadas pela família de Antônio Augusto Bicalho Canêdo, o maior proprietário de escravos da freguesia de São Paulo do Muriahé. As fontes utilizadas serão os registros de batismos, casamentos e o inventário post-mortem relacionadas ao nosso personagem.

Neste trabalho apresentamos alguns resultados da pesquisa de doutorado desenvolvida junto à faculdade de Educação da Universidade de São Paulo entre 2002 e 2006, com o título: Ética do discurso e Ética Universal do Ser Humano: convergências entre Paulo Freire e Jurgen Habermas. Trata-se de uma breve descrição dos resultados obtidos, no intuito de aproximar o pensamento de dois autores complexos e de grande importância no pensamento filosófico mundial. Por um lado temos Paulo Freire e sua preocupação (...) em relacionar educação e crítica social libertadora. Por outro, o esforço gigantesco de Jürgen Habermas em produzir uma grande interpretação sobre o mundo, defendendo o projeto inicial da modernidade. Ambos se aproximam no final da década de 1990, chegando quase a um encontro pessoal, no âmbito da Teoria Crítica da Sociedade, quando seguidores de lado a lado identificam conceitos e intenções próximos, como a ideia do diálogo qualificado, de uma ética universalista possível, de uma emancipação humana no horizonte. O artigo visa analisar as abordagens realizadas sobre a participação e importância, ou não, dos líderes farrapos na Revolta de 1957, ocorrida no Sudoeste do Paraná, que resultou na derrota das companhias de terra e do governo de Moysés Lupion que praticavam a grilagem nas terras das glebas Missões e parte da Chopim. Nas abordagens sobre a revolta, predomina a exaltação dos líderes urbanos que atuaram no período de 1951 até outubro de 1957, bem como no período seguinte à derrota (...) lupionista, uma vez que se tornaram dirigentes políticos e considerados “heróis” do levante de Outubro de 1957, pois a vitória teria ocorrido sem o derramamento de sangue. Todavia, as referências dos líderes farrapos na área de fronteira com a Argentina, principalmente de Pedro Santin, ficaram em segundo plano ou como exemplo negativo a ser seguido e rememorado. Paulo Arantes explora a imagem original de fronteira que nasce com a modernidade e reflete sobre seus desdobramentos na atualidade geopolítica. O ponto de partida é a tese do sociólogo polonês Zygmunt Bauman de que os atentados de 11 de setembro de 2001 teriam marcado o fim simbólico da “era do espaço” e inaugurado uma era de vulnerabilidade permanente que ele denomina “terra de fronteira global”. Arantes recupera a teoria schmittiana de “nomos da terra” para explicar a transformação em (...) curso. Interessa-lhe sobretudo o poder de desmistificação do pensamento liberal moderno que a franqueza do jurista alemão reacionário oferece. Afinal, sua teoria da vinculação intrínseca entre ordenamento jurídico e enraizamento espacial permite reconhecer na descoberta do Novo Mundo e na experiência colonial a precondição da instauração do jus publicum eruropaeum, do reconhecimento mútuo de Estados soberanos europeus e da consequente racionalização e descriminalização da guerra próprios da constituição do capitalismo. Na contramão da euforia globalizante da ideologia contemporânea, a teoria de Schmitt revela como o núcleo orgânico do capitalismo e sua periferia colonial surgem juntos e devem terminar separados, pois o fosso entre ambas seria constitutivo. A segunda consequência extraída é de que se o fundamento do estado de direito na Europa é seu avesso no ultramar, esse processo também é coetâneo de um pensamento por linhas globais. É nesse contexto que Arantes procura refletir sobre a novidade identificada por Bauman e já intuída por Schmitt no pós-guerra com o surgimento de uma potência nacional fora da Europa e que passa a reivindicar autoridade sobre um espaço já não é mais nacional. Demarcando uma nova linha global denominada “hemisfério ocidental”, os EUA inaugurariam também um novo conceito de soberania que despreza a antiga noção de anexação territorial e desarticula a relação intrínseca entre direito, Estado e territorialidade – processo que remonta tanto ao esgotamento da sangrenta expansão na frontier estadunidense quanto à vitória bélica avassaladora da jovem nação americana no desfecho das guerras mundiais às portas da Era Atômica. Os atentados contra o World Trade Center e os desmandos da política externa do Governo Bush aparecem assim como apenas as manifestações mais recentes e vistosas desse novo paradigma histórico em que tudo tornou-se fronteira e cuja marca é a generalização do estado de sítio. Este trabalho tem como propósito contribuir para a desmistificação das atribuições pejorativas sugeridas por diferentes atores do campo não progressista, sustentadas em desinformação e falta de referenciais sólidos de análise, sobre o sentido emancipatório da obra de Paulo Freire e suas incidências sobre a educação em direitos humanos. Também tem o objetivo de analisar as sugestões teóricas de Freire como caminhos para a construção de mecanismos de consolidação de uma radicalidade democrática no seio da sociedade brasileira. Setores da sociedade (...) sugerem que Paulo Freire seria um autor de vertente marxista, postulador de doutrinas ortodoxas “esquerdistas” nos processos de educação formal, justificando propostas cujo teor têm como objetivo a contraposição a esta suposta doutrinação, como o projeto denominado “Escola sem partido”. Buscamos demonstrar que Paulo Freire tem como preocupação primeira o de caráter ontológico nos processos educativos, a formação humana, indicando meios educacionais para o aprimoramento da reflexão e da ação intimamente relacionadas, que levem ao aprimoramento do ser humano e que, no bojo desta preocupação, existe um objetivo maior, emancipatório, comportando todas as ordens deste aprimoramento: a promoção da justiça, o caráter laico e universal da escola pública, o direito à livre manifestação de ideias, o respeito às realidades culturais de cada estudante, a construção coletiva do conhecimento e a defesa dos direitos humanos. Este artigo tem como finalidade analisar aspectos teóricos comuns entre o historiador inglês Edward Palmer Thompson e o educador brasileiro Paulo Freire, como a crítica ao idealismo marxista desvinculado da experiência cultural dos sujeitos e a consequente negação de seu papel na história. Não há a pretensão de incluir os dois autores em um mesmo campo teórico, um marxismo, mas destacar que a cultura - enquanto modos de vida e experiência em Thompson – e como leitura de mundo em (...) Freire, se constitui como fundamento da historiografia social e da educação popular humanizadora. Desta forma, o marxismo e a educação são vistos de baixo. (shrink)

O presente artigo procura resgatar um dos períodos mais intensos e menos estudados da Guerra Fria no Brasil, quando duas correntes militares antípodas política e ideológicas atuaram na perspectiva de influenciar através de suas entidades de classe um projeto de nação. Entretanto, essa reflexão tem por foco, os militares nacionalistas e de esquerda, oficiais e praças das forças armadas cuja intervenção foi bem sucedida ao final, com a vitória da Tese do Monopólio Estatal do Petróleo e não intervenção brasileira (...) no conflito coreano, embora ao custo de uma repressão sobre centenas de militares, muitos deles presos e torturados e até hoje não anistiados, demonstrando em última instância, a fragilidade da democracia e do Estado Democrático e de Direito no Brasil.The Military and the Cold War in Brazil The present article seeks to recover one of the most intense and least studied period of the Cold War in Brazil, when two military antipodal political and ideological currents acted in the perspective of influencing through its class entities a nation project. However, this reflection is focused on the nationalist and leftist military, officers and squares of the armed forces whose intervention was successful in the end, with the victory of the Thesis of the State Petroleum Monopoly and not Brazilian intervention in the Korean conflict, although at cost of a crackdown on hundreds of soldiers, many of them imprisoned and tortured and still unamused, demonstrating in the last instance the fragility of democracy and the Democratic State and Law in Brazil. Resumen Los Militares y la Guerra Fría en Brasil El presente artículo busca rescatar uno del período más intensos y menos estudiados de la Guerra Fría en Brasil, cuando dos corrientes militares antípodas políticas e ideológicas actuaron en la perspectiva de influenciar a través de sus entidades de clase un proyecto de nación. Sin embargo, esta reflexión tiene por foco, los militares nacionalistas y de izquierda, oficiales y plazas de las fuerzas armadas cuya intervención fue exitosa al final, con la victoria de la Tesis del Monopolio Estatal del Petróleo y no intervención brasileña en el conflicto coreano, aunque al costo de una represión sobre cientos de militares, muchos de ellos presos y torturados y hasta hoy no aniquilados, demostrando en última instancia, la fragilidad de la democracia y del Estado Democrático y de Derecho en Brasil. This paper revisits the main thoughts of the Filipino historian and social critic Renato Constantino on the role of education in the formation of a neocolonial and postcolonial consciousness. It suggests that Constantino’s critical stance towards education embodies a type of philosophizing about education that centers on the problematization of the language of instruction, on the rendering of voice to those in the margins of Philippine society, and on taking a critical stance about education itself. It suggests further that (...) this form of philosophizing about education and its instrumentalities is prospective of a Freirean liberating pedagogy that is inherently nonneutral, critical, dialogical, praxical, and transformative. Paulo Margutti e José Crisóstomo discutem sobre a possiblidade ou a impossibilidade de ultrapassar o representacionismo correspondentista e principalmente o eventual linguocentrismo da filosofia contemporânea, pós-virada linguística, em que parece que da linguagem pode-se passar apenas à linguagem, a cujo círculo mágico estaríamos, desse modo, inevitavelmente presos. Sendo assim, o mundo “aí fora” novamente nos escapa e o relativismo, o agnosticismo e o ceticismo de novo nos espreitam. Em Nietzsche, é a linguagem, sempre metafórica, que se adéqua aos nossos (...) modos prático-perspectivistas, corpóreos e afetivos, de “recortar” o mundo, ou é o contrário? E em Maturana, o que vem primeiro? Para Crisóstomo, para quem no começo está o ato, ultrapassamos tudo isso através de nosso emaranhamento prático com o mundo, por meio da natureza sensível criativa de nossas práticas e pela tradução de crenças em condutas. Enquanto que, para Margutti, nada disso parece deslocar a primazia incontornável da linguagem, como prática ela própria. Sobre isso, Margutti pergunta pelo suposto aproveitamento, por Crisóstomo, no seu ponto de vista prático-poiético criativo, em versão alegadamente não idealista nem dualista, da noção de autoconsciência, central no idealismo alemão. Autonomous artificial intelligence (AI) systems can lead to unpredictable behavior causing loss or damage to individuals. Intricate questions must be resolved to establish how courts determine liability. Until recently, understanding the inner workings of “black boxes” has been exceedingly difficult; however, the use of Explainable Artificial Intelligence (XAI) would help simplify the complex problems that can occur with autonomous AI systems. In this context, this article seeks to provide technical explanations that can be given by XAI, and to show how (...) suitable explanations for liability can be reached in court. It provides an analysis of whether existing liability frameworks, in both civil and common law tort systems, with the support of XAI, can address legal concerns related to AI. Lastly, it claims their further development and adoption should allow AI liability cases to be decided under current legal and regulatory rules until new liability regimes for AI are enacted. The standard approach to the core phenomenology of thought insertion characterizes it in terms of a normal sense of thought ownership coupled with an abnormal sense of thought agency. Recently, Fernández (2010) has argued that there are crucial problems with this approach and has proposed instead that what goes wrong fundamentally in such a phenomenology is a sense of thought commitment, characterized in terms of thought endorsement. In this paper, we argue that even though Fernández raises new issues that enrich (...) the topic, his proposal cannot rival the version of the standard approach we shall defend. (shrink)

Experimental results in reference to Brazilian children and adults are presented in the context of current discussions about essentialism and folkbiology. Using an adoption paradigm, we replicate the basic findings of a previous article in this journal concerning the early emergence in children of a birth-parent bias. This cognitive bias supports the claim that causal essentialism cross-culturally constrains the reasoning about the origin, development and maintenance of the characteristics and identity of living kinds. This article examines the evaluative nature of the folk concepts of weakness and strength of will and hypothesizes that their evaluative nature is strongly connected to the folk concepts of blame and credit. We probed how people apply the concepts of weakness and strength of will to prototypical and non-prototypical scenarios. While regarding prototypical scenarios the great majority applied these concepts according to the predictions following from traditional philosophical analyses. When presented with non-prototypical scenarios, people were divided. Some, against traditional (...) analyses, did not apply these concepts, which we explain in terms of a clash of evaluations involving different sorts of blame and credit. Others applied them according to traditional analyses, which we explain in terms of a disposition to be reflective and clearly set apart the different sorts of blame and credit involved. One important issue in moral psychology concerns the proper characterisation of the folk understanding of the relationship between harmful transgressions and moral transgressions. Psychologist Elliot Turiel and associates have claimed with a broad range of supporting evidence that harmful transgressions are understood as transgressions that are authority independent and general in scope which, according to them, characterises these transgressions as moral transgressions. Recently many researchers questioned the position advocated by the Turiel tradition with some new evidence. We entered this debate (...) proposing an original, deflationary view in which perceptions of basic-rights violation and injustice are fundamental for the folk understanding of harmful transgressions as moral transgressions in Turiel's sense. In this article we elaborate and refine our deflationary view, while reviewing the debate, addressing various criticisms raised against our perspective, showing how our perspective explains the existent evidence, and suggesting new lines of inquiry. The capability approach developed by Amartya Sen focuses on the enhancement of people’s capabilities, i.e. their real freedom to choose a life course they have reason to value. Applying the CA to the organizational context, the focus of human resource management is transformed, shifting away from the needs of the organization to the freedoms of the individual. This shift happens also inside the so-called ‘liberated companies,’ firms with an organizational form that allows employees the complete freedom, along with the responsibility, (...) to take any actions they decide are best. In this paper we show the contribution of the capability approach for management and for organizational ethics by focusing on this innovative model of ‘liberated companies.’. (shrink)

This paper concerns a recently discovered, puzzling asymmetry in judgments of whether an action is intentional or not (Knobe, Philosophical Psychology 16:309–324, 2003a ; Analysis 63:190–193, b ). We report new data replicating the asymmetry in the context of scenarios wherein an agent achieves an amoral or immoral goal due to luck. Participants’ justifications of their judgments of the intentionality of the agent’s action indicate that two distinct folk concepts of intentional action played a role in their judgments. Neste texto, procuro encontrar as origens de um dos mais importantes conceitos de Gilles Deleuze, o conceito de Imagem-tempo. Este conceito remete-nos para os primeiros textos de Deleuze dedicados à filosofia de Espinosa e ao problema do autómato espiritual e relaciona-se directamente com o problema da passividade/actividade do espectador. Ou seja, o conceito crucial na sua filosofia do cinema, a Imagem-tempo, esconde uma importante reflexão sobre a Imagem cinematográfica como arte de massas, os (im)poderes do pensamento e o modo fascista (...) de se pensar. This text seeks to find the origins of one of the most important of Gilles Deleuze's concepts, the concept of Time-image. This concept leads us to his first texts regarding Spinoza's philosophy and the problem of the spiritual automaton, and concerns directly with the problem of passivity/activity of the film goer. That is to say that the crucial concept of his film philosophy, Time-image, hides a fundamental consideration on the cinematic image as a mass art, the (un)powers of thinking and the fascist way of thought. Many contemporary ethicists use case-based reasoning to reach consistent beliefs about ethical matters. The idea is that particular cases elicit moral intuitions, which provide defeasible reasons to believe in their content. However, most proponents of case-based moral reasoning are not very explicit about how they resolve inconsistencies and how they abstract principles from judgments about particular cases. The aim of this article is to outline a methodology—called Consistency Reasoning Casuistry—for case-based reasoning in ethics. This methodology draws on Richmond Campbell and (...) Victor Kumar’s naturalistic model for the resolution of inconsistencies between the content of intuitions about particular cases. I argue that reasons similar to those that motivate their model also support a more abstract form of moral reasoning that goes beyond mere resolutions of inconsistencies between case judgments and demands the formulation of more abstract moral norms. Consistency Reasoning Casuistry, it is argued, is a good candidate for a methodology for case-based moral reasoning that is in harmony with paradigms of contemporary moral psychology and that can accommodate the methodology implicit in the work of many contemporary ethicists. This article elaborates on the relation between ethical casuistry and common law reasoning. Despite the frequent talk of casuistry as common law morality, remarks on this issue largely remain at the purely metaphorical level. The article outlines and scrutinizes Albert Jonsen and Stephen Toulmin’s version of casuistry and its basic elements. Drawing lessons for casuistry from common law reasoning, it is argued that one generally has to be faithful to ethical paradigms. There are, however, limitations for the binding force of (...) paradigms. The most important limitations—the possibilities of overruling and distinguishing paradigm norms—are similar in common law and in casuistry, or so it is argued. These limitations explain why casuistry is not necessarily overly conservative and conventional, which is one line of criticism to which casuists can now better respond. Another line of criticism has it that the very reasoning from case to case is extremely unclear in casuistry. I suggest a certain model of analogical reasoning to address this critique. All my suggestions to understand and to enhance casuistry make use of common law reasoning whilst remaining faithful to Jonsen and Toulmin’s main ideas and commitments. Further developed along these lines, casuistry can appropriately be called “common law morality.”. (shrink)

What should we do if climate change or global injustice require radical policy changes not supported by the majority of citizens? And what if science shows that the lacking support is largely due to shortcomings in citizens’ individual psychology such as cognitive biases that lead to temporal and geographical parochialism? Could then a plausible case for enhancing the morality of the electorate—even against their will –be made? But can a democratic government manipulate the will of the people without losing democratic (...) legitimacy? This paper explores the problems that governmental manipulation of voters pose for democratic legitimacy and the tensions between non-manipulated input and morally acceptable output. These venerable issues of political theory resurface in light of recent suggestions to tackle today’s global mega-problems by Ingmar Persson and Julian Savulescu. They suggest that to avert the looming catastrophe, governments should alter psychological traits of the citizenry through biomedical means, from pharmaceuticals to genetics. However, we argue that a government cannot rule with democratic legitimacy if elected by a will of the people it manipulated before. Normatively, conferring power from the governed onto governors is a one-directional relation that is incompatible with manipulation. But while it is tempting to rebut suggestions to morally enhance the people as antithetical to essential ideas of democracy, swift rebuttals tend to overlook the deeper challenge: Majoritarian decision-making may lead to inacceptable outcomes. The dilemma between input and output runs through major works in political theory. Rather than wishfully ignoring the dangers of democracy, democratic theory has to provide answers. (shrink)

Russell’s theory of memory as acquaintance with the past seems to square uneasily with his definition of acquaintance as the converse of the relation of presentation of an object to a subject. We show how the two views can be made to cohere under a suitable construal of ‘presentation’, which has the additional appeal of bringing Russell’s theory of memory closer to contemporary views on direct reference and object-dependent thinking than is usually acknowledged. The drawback is that memory as acquaintance (...) with the past falls short of fulfilling Russell’s requirement that knowledge by acquaintance be discriminating knowledge – a shortcoming shared by contemporary externalist accounts of knowledge from memory. This article presents a parametrized functional interpretation. Depending on the choice of two parameters one obtains well-known functional interpretations such as Gödel's Dialectica interpretation, Diller-Nahm's variant of the Dialectica interpretation, Kohlenbach's monotone interpretations, Kreisel's modified realizability, and Stein's family of functional interpretations. A functional interpretation consists of a formula interpretation and a soundness proof. I show that all these interpretations differ only on two design choices: first, on the number of counterexamples for A which became witnesses for ¬A when defining (...) the formula interpretation and, second, the inductive information about the witnesses of A which is considered in the proof of soundness. Sufficient conditions on the parameters are also given which ensure the soundness of the resulting functional interpretation. The relation between the parametrized interpretation and the recent bounded functional interpretation is also discussed. (shrink)

The law serves functions that are not often taken seriously enough by ethicists, namely feasibility and practicability. A consequence of feasibility is that most laws do not meet the demands of ideal ethical theory. A consequence of practicability is that law requires elaborated and explicit methodologies that determine how to do things with norms. These two consequences form the core idea behind this book, which employs methods from legal theory to inform and examine debates on methodology in applied ethics, particularly (...) bioethics. It is argued that almost all legal methods have counterparts in applied ethics, which indicates that much can be gained from comparative study of the two. The author first outlines methods as used in legal, focusing on deductive reasoning with statutes as well as analogical reasoning with precedent cases. He then examines three representative kinds of contemporary ethical theories, Beauchamp and Childress’s principlism, Jonsen and Toulmin’s casuistry, and two versions of consequentialism—Singer’s preference utilitarianism and Hooker’s rule-consequentialism—with regards to their methods. These examinations lead to the Morisprudence Model for methods in applied ethics. (shrink)

This Article defines four distinct conceptions of cruelty found in underdeveloped form in domestic and international criminal law sources. The definition is analytical, focusing on the types of agency, victimization, causality, and values in each conception of cruelty. But no definition of cruelty will do justice to its object until complemented by the kind of understanding practical reason provides of the implications of the phenomenon of cruelty. -/- No one should be neutral in relation to cruelty. Eminently, cruelty in criminal (...) law, a human-created phenomenon, vigorously calls for responses in the form of preventive and corrective action on the part of private and public actors. It is in this sense that cruelty is a problem of practical reason, one of action preoccupied with its legal or moral obligations, rational grounds, value commitments, and actual consequences. -/- However, the connection between conceptions of cruelty and the implications practical reason can draw from the correct application of a conception of cruelty to phenomena in the world remains too detached to be able to capture and explain people's actual experiences both of seeing cruelty in the world and of confronting the question of what to do about cruelty and how to address its cultural and institutional aspects. Something is missing. -/- What is missing is the integration of conceptions of cruelty and the practical reason implications of detecting cruelty in the world into normative models which operate as meaning matrixes for cognition, meaning, and action. This Article undertakes this explanatory task through an exercise of reconstructing seminal philosophical ideas about cruelty. The result is that the four conceptions of cruelty are placed within three distinct normative models, which ultimately render intelligible legal conceptions of cruelty and legal reactions to it. From the standpoint of the school settings, sport participation constitutes a key strategy concerning the manifestation of positive behaviors that result from the development of personal and social responsibility. Based on the TPSR model, the goal of this study was to evaluate the effects of an intervention geared toward teaching life skills through sport to youngsters who had been committed. The participants were evaluated before and after the intervention. After the initial evaluation, they were randomly assigned to the experimental and (...) control groups. The experimental group took part in the community football program, while the control group attended physical education classes not based on the TPSR model. The experimental model consisted of 3 weekly sessions over the course of 6 weeks, which totaled 18 sessions. This investigation supplied empirical evidence concerning the potential of community sport programs in the teaching and development of life skills deemed necessary for an adequate reintegration of such at-risk youngsters. The model was shown to be valid both in stimulating changes of attitudes and in promoting the adherence to socially positive behaviors. The effectiveness of the model, as well as its unique approach, make its application attractive to both the youngsters and the professionals. This program facilitates the training of youngsters to act, in the sense of promoting both their autonomy and the acquisition of a system of ethics and moral values within a culture of responsibility for how decisions affect the individual and the community. Finally, this intervention generated empirical support in favor of the argument that sport constitutes a unique opportunity within the educational process to establish values, beliefs, attitudes, and practical habits pertaining relationships and cooperation that generate social responsibility in individuals. Dans le corps du droit - souvent méprisé, souvent ignoré -, les symboles, l'iconologie, mais aussi la relation du juridique avec les arts et l'esthétique, gagnent de nos jours de plus en plus d'importance. On redécouvre une relation entre le droit et les sens : le droit qui écoute les parties, le droit dit aveugle ou le droit bandé, le droit qui sent et pressent par l'odorat, le (...) droit qui touche, et même un droit qui dé-gôute... La présente contribution pour une philosophie symbolique du droit recueille des études sur les différents aspects de ce droit sensible et sensitif. (shrink)

Resumo: Ao considerar as ações que são propriamente humanas, as quais pertencem ao homem enquanto homem, Tomás de Aquino destaca aquelas ações que procedem da vontade deliberada e que visam a um determinado fim, uma orientação que será caracterizada como algo inscrito no próprio ser da criatura e acompanhada de certo conhecimento. Este artigo almeja estudar a constituição do ato moral para Tomás, fazendo ressaltar não apenas a centralidade da vontade na constituição desse ato, mas também certos assuntos pertinentes à (...) reflexão tomasiana do ato moral, como a distinção voluntário/involuntário, a coexistência de inteligência e vontade na determinação do ato humano e a qualificação da ação que é imperada pela vontade, pois é nela que se manifestará de modo mais claro o agir ético para Tomás, demarcado este pelo signo da prudência. A referência textual de Tomás, aqui utilizada, diz respeito à segunda parte da Suma de teologia.: In considering actions that are properly human, which belong to man as man, Thomas Aquinas highlights those actions that proceed from deliberate will and aim at a certain end. This orientation is characterized as something inscribed in the very being of the creature and accompanied by knowledge of a certain kind. This article aims to study the constitution of the moral act for Aquinas. It emphasizes not only the centrality of the will in the constitution of this act, but also certain issues pertinent to Aquinas’ reflection on the moral act. For example, the voluntary/involuntary distinction, the coexistence of intelligence and will in the determination of the human act, and the qualification of action dominated by the will. It is in action that the ethical act for Aquinas is most clearly manifested, marked by the sign of prudence. The primary text referred to in this article is the second part of the Summa theologiae. In conventional medicine, healing is effected mainly by treating the symptoms of the physical body disease, while in mind?body medicine the cure is performed by the mind itself (thoughts and emotions). In fact, the holographic mind theory claims that the mind could be either the healer or the slayer. Thus, this article is a contribution toward a more in-depth study of this theme of conventional medicine versus mind?body medicine, particularly to understand the gifts of quantum physics to life science and (...) the art of healing, so that we might find an integrative medicine model (a holistic approach to health) that could explain some ?incurable? diseases. What is cruelty? How and why does it matter? What do the legal rejection of cruelty and the requirements of mercy entail? This essay asks these questions of Lucius Seneca, who first articulated an agent-based conception of cruelty in the context of punishment. The hypothesis is submitted that the answers to these questions offered in Seneca's De clementia constitute one of the turning points in the evolution of practical reason in law. I conclude, however, by arguing that even the mainstream (...) punitive practices of contemporary western societies fail to meet the modest imperatives of the rejection of cruelty and the unconditionality of mercy propounded by Seneca. Cependant, l’assimilation existentielle de l’impossibilité de la métaphysique par Kleist déclenche non seulement le sentiment de finitude et d’humilité de la raison, mais aussi le refus tragique, désespéré, d’une science strictement phénoménale et d’une solution croyante pour apaiser son besoin de vérité absolue. Ainsi, une catastrophe, comme le tremblement de terre de Lisbonne ou du Chili, convoque des significations contrastées : Kant s’attache à la mécanique naturelle et à la possibilité d’un dessein inscrutable, tandis que Kleist éprouve la vie sous le signe du hasard, « voyage sans but », dont le mouvement offre le dynamisme diasporique du salut impossible.
